Terms of Service

Please read these terms carefully before using LaMoon.

1. Acceptance of Terms

By accessing or using LaMoon, you agree to be bound by these Terms of Service and all applicable laws. If you do not agree with any part of these terms, you may not use LaMoon.

2. Eligibility

You must be at least 13 years old to use LaMoon. If you are under 18, you must have your parent or guardian's permission. By using LaMoon, you confirm you meet these requirements. You must be at least 18 years old (or the age of majority where you live) to purchase Coins or subscriptions, send or receive virtual gifts, host live streams, or receive creator payouts.

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials confidential
• Accept responsibility for all activities under your account
• Notify LaMoon immediately of any unauthorised account access

3.2 Account Termination

LaMoon may suspend or terminate accounts at any time for violation of these Terms or conduct determined harmful to LaMoon, other users, or third parties.

4. LaMoon Premium & Subscriptions

4.1 Subscription Plans

LaMoon Premium provides access to exclusive content, creator messaging, and ad-free viewing. Fees are charged in advance on a monthly or annual basis. Subscriptions renew automatically, and your payment method is charged at the start of each renewal period, until you cancel. Purchases made through the Apple App Store or Google Play are also subject to that store’s payment and refund terms.

4.2 Cancellation & Refunds

You may cancel your subscription at any time via account settings. Cancellations take effect at the end of the billing period. Refunds are not provided for partial periods except as required by law. If LaMoon terminates your account, you may apply for a pro-rata refund of the unused portion of your current billing period; requests are reviewed within fifteen (15) to thirty (30) business days and may be declined where the termination results from fraud or payment abuse.

5. LaMoon Coins & Gifting

LaMoon Coins are virtual currency used to send gifts, unlock premium content, and access features. LaMoon Coins:

• Have no monetary value and are non-refundable except as required by law
• Cannot be exchanged for real currency
• Do not expire while your account remains active, but may be forfeited if your account is terminated for violation of these Terms. If your account is terminated, you may apply for a refund of the unused balance of purchased Coins; refund requests are reviewed within fifteen (15) to thirty (30) business days and may be declined where the termination results from fraud or payment abuse

Creator gift earnings are subject to LaMoon's revenue sharing terms and applicable taxes.

6. Content & Conduct

By posting content on LaMoon, you grant LaMoon a non-exclusive, worldwide, royalty-free licence to host, use, reproduce, adapt (for technical purposes such as encoding and formatting), display, sublicense to service providers, and distribute that content through LaMoon's services. You retain ownership of your content. You also agree to comply with LaMoon’s Community Guidelines and, if you monetise content, the Creator Policy, both of which are incorporated into these Terms by reference.

You agree not to use LaMoon to:

• Upload content that violates intellectual property rights
• Harass, threaten, or harm any individual or group
• Distribute spam, malware, or deceptive content
• Scrape or extract data without LaMoon's written consent
• Impersonate any person or entity

Copyright Complaints (DMCA). If you believe content on LaMoon infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated copyright agent at dmca@lamoon.network. We will remove or disable access to material identified in a valid notice, the uploader may submit a counter-notice, and we will terminate the accounts of repeat infringers in appropriate circumstances.

7. Intellectual Property

LaMoon and its licensors own all intellectual property in the LaMoon platform, including software, design, and trademarks. Nothing in these Terms grants you rights to LaMoon's name, trademarks, or proprietary information.

8. Disclaimers & Limitation of Liability

LaMoon is provided 'as is' without warranties of any kind. To the maximum extent permitted by law, LaMoon shall not be liable for indirect, incidental, or consequential damages arising from your use of LaMoon.

9. Governing Law

These Terms are governed by the laws of the State of California, U.S.A., without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or LaMoon will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. You and LaMoon each waive any right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration provision by emailing creator@lamoon.network within 30 days of first accepting these Terms.

10. Changes to Terms

LaMoon may modify these Terms at any time with notice through the app or by email. Continued use of LaMoon following notice of changes constitutes acceptance.
